0213el_curray_1Since November 7, 1986, employers have been required by law to examine documents and complete the I-9 Employment Eligibility Verification Form to verify that all new employees are authorized to work in the U.S. On March 8, 2013, U.S. Citizenship and Immigration Services (USCIS) released a new Form I-9.

The group of senators involved in drafting the proposal include the following from the Republican Party: John McCain (Arizona), Marco Rubio (Florida), Lindsey Graham (South Carolina) and Jeff Flake (Arizona).

Senators from the Democratic Party included Chuck Schumer (New York), Dick Durbin (Illinois), Bob Menendez (New Jersey) and Michael Bennet (Colorado).

The Obama administration recently announced a dramatic shift in its immigration enforcement priorities. The administration’s focus until now has been on the enforcement of immigration laws against employers through Form I-9 inspections and against individuals through programs like Secure Communities, resulting in a dramatic increase in deportations.

The Department of Homeland Security (DHS) will now consider suspending the deportation of certain undocumented young adults who entered the U.S. as children.

These individuals would also receive a work permit, renewable on a two-year basis, through a process called “deferred action.” The policy may affect as many as one million undocumented immigrants who would have been eligible for the DREAM Act that was under consideration in late 2010.

On June 15, 2012, Secretary of Homeland Security Janet Napolitano issued a memorandum announcing a new prosecutorial discretion program that will offer grants of deferred action, in two-year increments, to certain individuals who entered the U.S. as children.

With a grant of deferred action, individuals will also be eligible for work authorization. Deferred action is a discretionary determination by the government not to deport an individual.

However, deferred action is not the same as permanent residence and deferred action does not place a person on a path to permanent residence.
